Wrap: The Fox News Network and its journalist Chris Wallace filed a lawsuit against Robin Carnahan through a Kansas City based law firm.

The lawsuit is over a smear ad that began appearing on television earlier this month.

The ad uses footage from a 2006 interview Wallace conducted with Republican Senate Candidate Roy Blunt.

Fox News released a statement saying the lawsuit was filed because it cannot appear as though  Wallace is endorsing any candidate.

The Carnahan campaign refused to comment but the ad has been removed from Youtube and Carnahan's website.
