The Department of Insurance is still deciding whether it will appeal a court decision that allows Blue Cross and Blue Shield of Missouri to keep about 500 million dollars in assets.
Cole County Circuit Judge Thomas Brown ruled the company did not have to pay a settlement to the state when it switched from a non-profit to a for-profit company.
Insurance Department spokesman, Randy McConell, says his department is dissapointed by the ruling.
McConell says department lawyers get the final say on a possible appeal.
Blue Cross Blue Shield maintains it has complied with Missouri law all along.
