Federal Court Says Law is too Vague

The 8th Circuit court of appeals today upheld an injunction on a state law requiring a 24 hour waiting period between an intial doctors visit and an abortion. Jonathan Levin has more from Jefferson City.

The ruling today said a state law requiring a 24 hour waiting period before an abortion is too vague.

The court said the lack of more concise language is unconstitutional.

Paula Gianino, Spokesperson for Planned Parenthood, says the criminal issues laid out by the bill need to be more clearly defined.

The law is being challenged on both the state and federal level. The Missouri Supreme Court already heard the case. A ruling from them should be out at the start of 2006.

A federal appeals court upheld a lower courts ruling on a state law requiring a 24 hour waiting period for women having an abortion. Jonathan Levin has more from the state Capitol.

The 8th Circuit Court of Appeals today ruled the language in a law requiring discussion during a 24-hour preabortion waiting period is too vague.

State Senator John Loudon says the law is suppose to be vague. The language is designed to promote as much discussion as possible before an abortion.
