Judge considers dismissal of a challenge to Missouri's gun control law.

A Cole County Circuit Judge considers dismissal of a challenge to Missouri's gun control law.

Cole County Circuit Judge Thomas Brown scheduled a hearing for St. Louis County's challenge to the law requiring county sheriffs to issue concealed weapons permits.

But Attorney General Jay Nixon's request to Brown to dismiss the county's suit went into consideration.

Nixon brought grounds for the dismissal, saying the issue is not yet ripe for a decision.

Brown plans to make a final decision on whether to dismiss the suit within the next few days.

Based on the Attorney General's request, Circuit Judge Thomas Brown is considering dismissal of a suit that asks the judge to declare the law unconstitutional.

This year, Missouri's Supreme Court said the Legislature could allow citizens to carry concealed weapons... but funding the system could force counties to carry out unfunded mandates.

Brown plans to make his decision regarding the dismissal within the next few days.

Circuit Judge Thomas Brown delayed the hearing on the state's gun control law because Attorney General Jay Nixon asked him to dismiss the suit altogether.

Nixon said the issue is not yet ripe for a decision.

But St. Louis County's suit says the state's unconstitutional acts will require the county to provide conceal and carry permits without state funding to do so.

Brown plans to make a final descision on the dismissal within the next few days.
