M-U Law professor Carl Esbeck argues that current Missouri statutes do not effectively prohibit same sex marriages. Esbeck has written a number of publications dealing with church-state relations. Republican Senator Peter Kinder referred to Esbeck's argument when he suggested same sex marriages threaten the Judeo-Christian tradition of marriage between man and woman.

Even if religious organizations decide to bless same sex marriages in the future, Kinder says he'll still oppose them. The Senate has given preliminary approval to a bill that would not recognize homosexual marriages.
